JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused Nos.1 and 3 under Sections 439 of Cr.P.C. praying to grant bail in S.C.No.114/2022 arising out of Crime No.428/2015 of Madanayakanahally Police Station, registered for offence punishable under Section 397 of IPC, pending on the file of Additional District and Sessions Judge and FTSC-II, Bangalore Rural District, Bangalore. 2. Heard the learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Petitioner No.1 has been granted bail in Crl.P.No.2061/2016 by order dated 08.07.2016 and has - 3 - HC-KAR NC: 2026:KHC:11909 CRL.P No. 10906 of 2025 been released on 22.07.2016. Petitioner No.2/accused No.3 has been granted bail by order dated 29.12.2016 passed in S.C.No.18/2016 and he has been released on 09.12.2016. Thereafter the case came to be registered and petitioners appeared in S.C.No.18/2016. As the petitioners remained absent, subsequently case against them has been split up and split-up case has been registered in S.C.No.114/2022. The trial Court by order dated 17.05.2025 has cancelled the bail bonds of the petitioners. The NBW issued against the petitioners has been executed and they have been secured on 30.05.2025 and since then they are in judicial custody. The petitioners now have deposited Rs.50,000/- each, before the Sessions Court in S.C.No.114/2022 on 21.02.2026 towards the forfeited bond amount. The said deposits made by the petitioners are required to be appropriated to the State towards forfeited bond amount. The petitioners could not appear before the trial Court due to miscommunication between them and their counsel. Petitioners have now - 4 - HC-KAR NC: 2026:KHC:11909 CRL.P No. 10906 of 2025 undertaken to appear before the trial Court and co-operate for speedy disposal of the case. 4. Considering the above aspects, the petitioners have made out a case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. Petitioners/accused Nos.1 and No.3 are granted bail in S.C.No.114/2022 arising out of Crime No.428/2015 of Madanayakanahally Police Station, pending on the file of Additional District and Sessions Judge and FTSC-II, Bangalore Rural District, Bangalore, subject to following conditions. (i) Petitioners shall execute bail bond for a sum of Rs.1,00,000/- each, with one surety for the like sum to the satisfaction of the trial Court. (ii) Petitioners shall not tamper the prosecution witnesses either directly or indirectly. - 5 - HC-KAR NC: 2026:KHC:11909 CRL.P No. 10906 of 2025 (iii) Petitioners shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
