JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner seeks Emergency Parole for her husband, Sri.Prasanna Kumar.M, who is in incarceration on conviction in SC No.67/2018 on the file of the III Additional District and Sessions Judge, Kolar. The petitioner's husband is convicted for the offences punishable under Section 302 read with 34 of Indian Penal Code and other offences punishable under the Indian Penal Code, 1860. The petitioner refers to the application over e-mail dated 16.02.2026 for the grant of emergency parole to the petitioner. Sri. B.Ravindranath, the learned Additional Government Advocate who accepts notice for the respondents, submits that if the e-mail is dated 16.02.2026, this petition is filed on 18.02.2026. The learned Additional Government Advocate also submits that if the second respondent, who has to - 4 - HC-KAR NC: 2026:KHC:10574 WP No. 5547 of 2026 verify the certificates relied upon by the petitioner, is granted reasonable time, the decision will be communicated to the petitioner over e-mail. This Court must observe that in terms of paragraph 645 of the Karnataka Prisons and Correctional Services Manual 2021, the Chief Superintendent will have to ascertain the genuineness of certificate from the jurisdictional police through wireless or even over e-mail and then decide on grant of Emergency Parole. This Court therefore is persuaded to dispose of this petition directing the second respondent to verify the genuineness of the certificate and decide on whether the petitioner's husband must be admitted to Emergency Parole.
