By means of the present writ petition, the petitioner has sought quashing of the F.I.R. dated 17.01.2026, registered as Case Crime No. 10 of 2026, under Section 69 of the Bharatiya Nyaya Sanhita, 2023, at Police Station Kaliyar Sharif, District Haridwar, along with all consequential proceedings arising therefrom. The petitioner has also prayed that he may not be arrested in connection with the aforesaid case. 3. A Compounding Application, jointly signed by learned counsel for the petitioner and learned counsel for respondent no. 3 and duly supported by the affidavits of the petitioner as well as respondent no. 3, has been filed before this Court. 4. Learned counsel appearing for respondent no. 3 submits that all disputes between the parties have been amicably resolved. It is submitted that respondent no. 3 has solemnized her marriage with another person and has voluntarily entered into the compromise of her own free will. She no longer wishes to pursue the criminal proceedings against the petitioner in order to maintain peace and harmony. 5. Today, the petitioner and respondent no. 3 are present before this Court through video UKHC010011772026 2026:UHC:5774 conferencing and have been duly identified by their respective learned counsel. 6. Respondent no. 3 has categorically stated that she has no objection if the impugned F.I.R. and all consequential proceedings arising therefrom are quashed. 7. This Court has interacted with respondent no. 3 and is satisfied that the compromise has been entered into voluntarily, without any coercion or undue influence, and out of her own free will. 8. Learned State Counsel submits that since the dispute is essentially personal in nature and both parties are major, he has no objection to the disposal of the writ petition in terms of the compromise. 9. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court finds that the parties have amicably settled their disputes. Respondent no. 3 has also solemnized her marriage with another person and does not intend to pursue the criminal proceedings. In view of the settlement arrived at between the parties and the peculiar facts and circumstances of the case, the possibility of conviction appears to be remote and bleak. Continuation of the criminal proceedings would serve no useful purpose and would amount to an abuse of the process of law. 10. Having regard to the principles laid down by the Hon'ble Supreme Court in Gian Singh v. State of Punjab, (2012) 10 SCC 303 and considering the peculiar facts and circumstances of the present case, this Court is of the considered opinion that the ends of justice would be served by quashing the criminal proceedings. 11. Accordingly, the Criminal Writ Petition is allowed. The F.I.R. dated 17.01.2026, registered as Case Crime No. 10 of 2026, under Section 69 of the Bharatiya Nyaya Sanhita, 2023, at Police Station Kaliyar Sharif, District Haridwar, along with all consequential proceedings arising therefrom, is hereby UKHC010011772026 2026:UHC:5774 quashed. 12. The Compounding Application stands disposed of accordingly. 13. Pending applications, if any, shall also stand disposed of.
