1. The present second bail application has been filed by the accused-applicant under Section 483 of BNSS in connection with FIR No. 05/2024 registered at Police Station Cyber Police Station (ATS and SOG), District ATS and SOG for the offences punishable under Sections 66D and 66C of the Information Technology (Amendment) Act, 2008 and Sections 419, 420, 406 & 120-B of Indian Penal Code, 1860.
2. The first bail application, bearing S.B. Criminal Miscellaneous Bail Application No. 15370/2024, filed on behalf of the accused- applicant-Sanjeev Kumar Suri was dismissed by this Court vide
order dated 03.07.2025.

Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter.
Learned counsel further submits that the accused-applicant was
[2026:RJ-JP:22014] (2 of 3) [CRLMB-254/2026] arrested on 19.11.2024 and since then, he is behind the bars.
Learned counsel argues that in this case Mone Singh, Raj Singh @ Shiv Shambhu Jha, Deepak and other accused persons have not been arrested yet. Learned counsel prays that the trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
4. On the other hand, learned Public Prosecutor opposed the bail application and submitted a factual report dated 25.05.2026. Learned Public Prosecutor also submits that as per the prosecution case, this is the case of cyber fraud, by which the linked phone number of the complainant was hacked and a fraud of Rs.55,00,000/- has been committed against the complainant. Further, Rs.25,00,000/- were transferred in the account of present accused-applicant-Sanjeev Kumar Suri, which were further transferred in the accounts of other account holders. Learned Public Prosecutor contends that it cannot be said that the accused- applicant has falsely been implicated in this case, therefore, looking to the seriousness of the offences, the accused-applicant should not be enlarged on bail.

6. Heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case that the first bail application filed on behalf of the accused-applicant was dismissed vide order dated 03.07.2025; there are total ten witnesses in this case and only three witnesses are remaining to be examined; this is a case of cyber fraud, wherein a fraud of Rs.55,00,000/- has been committed against the complainant,
[2026:RJ-JP:22014] (3 of 3) [CRLMB-254/2026] therefore, without expressing any opinion on the merits/demerits of the case, this Court is not inclined to grant bail to the present accused-applicant.
8. Accordingly, the present second bail application is dismissed, however, learned trial Court is directed to expedite the trial and conclude the same in timely manner.
