Also heard Shri SS Baghel, GA appearing for the respondent/State. 1. Petitioner has filed the present petition for the following reliefs:- “10.1 Call for the records, case diary with respect to Meg No.11/2022, PS Newai, District- Durg from the respondent police authorities. Digitally signed by V PADMAVATHI Date: 2026.01.29 11:41:58 +0530 Wpcr 50 of 2026 2 10.2 Call for the status report with respect to the investigation conducted / action taken by the concerned police officer(s) in Merg No.11/2022 for last almost 4 years. 10.3 This Hon’ble Court may direct the respondents to conduct the investigation in a timely manner including registration of FIR in prest case as well as also may direct to present their report in the instant case to the concerned judicial magistrate without any further delay. OR 10.4 As an alternative relief, this Hon’ble Court may entrust the investigation of the case to any senior police officer of the state and direct the said officer to conduct the investigation in time bound manner and present its report to the concerned court in accordance with law. 10.5 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the facts and circumstances of the present case, in the interest of justice.” 2. Learned counsel appearing for the petitioner would submit that despite several complaints/representations made by the petitioner, respondent authorities have not taken any action on the complaint made by the petitioner. 3. Learned State counsel, on the other hand, has submitted that the grievance of the petitioner can be very well redressed before the Court below by filing an application under Section 156 (3) Cr.P.C. He further submits that the controversy involved in the present matter has already been decided by the High Court of Allahabad in Misc. Bench No. Wpcr 50 of 2026 3 24492 of 2020 : Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 as well as by this Court in WPCR No.333 of 2020 (Akhilesh Agrawal v. State of Chhattisgarh & Others) decided on 12.04.2023, dismissing the said petition, hence, the present petition be also dismissed in terms of the said order. 4. Accordingly, the present writ petition is dismissed with liberty to the petitioner to avail the appropriate remedy before appropriate Forum.
