For Petitioner(s): Mr.R.Nandakumar For Respondent(s): Mr.K.Seetha Ram, Senior Standing Counsel ORDER This writ petition has been filed seeking the issuance of a writ of mandamus to consider and pass orders on merits and in accordance with law on the petitioner’s representation dated 31.10.2025 regarding the grant of promotion to the post of Assistant Sub Inspector on par with his batch- mates without reference to the punishment of Non qualifying service (NQS) for Over Stayed Leave (OSL) in the year 2010 within a time frame. 2. The case of the petitioner is that he was appointed as Constable (General Duty) in the Central Reserve Police Force on 08.09.2004 and has served in different battalions. In October 2010, the petitioner had availed leave due to illness and rejoined duty on 09.11.2010 along with medical documents. However, the department recorded Non-Qualifying Service https://www.mhc.tn.gov.in/judis WP No. 9406 of 2026 __________ Page3 of 6 (NQS) for the period 30.10.2010 to 07.11.2010 on the ground of overstayed leave, without conducting any proper inquiry or informing the petitioner. The petitioner had appeared for the Limited Departmental Competitive Examination (LDCE) for promotion to the post of Head Constable in 2011 and 2012, and successfully passed the examinations. Even though he had passed the examinations and obtained a “No Objection Certificate” (NOC), his name was not included in the final selection list. Subsequently, the department had refused to issue NOC for LDCE-2015 citing the petitioner’s alleged Non-Qualifying Service (NQS) for the period from 30.10.2010 to 07.1.2010. The petitioner states that the NQS entry was made only later in the year 2013 in his service book without following the proper procedures. Due to this entry, the petitioner lost promotion opportunities to the posts of Head Constable and subsequently, Assistant Sub-Inspector, while his juniors were promoted. The petitioner had submitted a representation on 31.10.2025 seeking promotion on par with his batchmates. However, no orders have been passed to date. Hence, the present Writ Petition has been filed seeking a Writ of Mandamus directing the respondents to consider the petitioner’s representation and grant promotion without taking into account the NQS punishment. https://www.mhc.tn.gov.in/judis WP No. 9406 of 2026 __________ Page4 of 6 3. Heard the learned counsels on either side and perused the materials available on record. 4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents to consider the representation of the petitioner dated 31.10.2025 and pass orders on merits and in accordance with law within a period of three weeks from the date of receipt of a copy of this order. 5.
