ORAL ORDER
The petitioners are before this Court seeking the following prayers:
"WHEREFORE, the petitioners are most humbly pray that this Honourable Court be pleased to call for the entire records and quash the entire proceedings in C.C. No.13307/2025 (Crime No.203/2021), pending on the file of the learned III Addl., Chief Judicial Magistrate, Bengaluru for the offences punishable under section 406, 420 read with 34 of the Indian Penal Code, registered by the 1st Respondent R.T. Nagar Police Station vide Annexure - 'A' and grant such other relief or reliefs as this Honourable Court deems fit to grant in the facts and circumstances of the case, in the interest of justice."
2. Heard Sri.Manjunatha A.C.,
learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.Srinatha B.V., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the petition, the parties to the lis have entered into a settlement and have filed an

application under Section 320(2) of the Cr.P.C., seeking compounding of the offence. 4. In the light of the offence being the one punishable under sections 406 and 420 of the Indian Penal Code, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners. The affidavit filed by respondent No.2 reads as follows:
"I, Surya. M.M. S/o. Murukan. M.K, aged about 33 years, R/at. Muzhangil House, Pallipuram Village, Cherai, Ernakulam, Kerala 683 514, Now at Bengaluru, do hereby state as follows:-
1. I am conversant with the facts of the case and I am swearing this affidavit as hereunder. 2. I swear that, on the basis of my complaint the Respondent No.1 herein has registered a case in Crime No. 203/2021 for the offence punishable under section 406, 420 read with section 34 of I.P.C and Section 21 and 22 of the Banning of Unregulated Deposit Schemes Act, 2019 against the Petitioner No. 1 to 3 herein i.e., accused No.1 to 3 and after investigation the case the 1st respondent police has filed a charge sheet before the learned 3rd Addl., Chief Judicial Magistrate, Bengaluru for the offence punishable under section 406, 420 read with section 34 of the IPC against the Accused/Petitioner No.1 to 3 herein now pending for consideration. 3. I swear that, in view of the Intervention of elders and well wishers of our respective family members. We settled our disputes in presence of respective well wishers out of the court, in view of the said settlement, I am not interested to prosecute the above said case before the learned 3rd Addl., Chief

Judicial Magistrate, Bengaluru, in C.C. No. 13307/2025 (Crime No.203/2021) for the offence punishable under Section 406, 420 read with section 34 of I.P.C, as such the said case filed by me may be quashed. 4.
4. I swear that, in order to preserve the precious time of the trail court this affidavit is filed to quash the proceedings in C.C. No. 13307/2025 (Crime No. 203/2021) pending before the learned 3rd Addl., Chief Judicial Magistrate, Bengaluru, for the offence punishable under Section 406, 420 read with section 34 of I.P.C.
5. I swear that, I had filed this affidavit on my own and will and consent without compulsion or pressure from any one. WHEREFORE, I pray that this Hon'ble court this affidavit may be taken on record and proceedings in C.C. No. 13307/2025 (Crime No.203/2021) for the offence punishable under Section 406, 420 read with section 34 of I.P.C, registered by Respondent No.1 R.T. Nagar Police Station, At Bengaluru now pending on the file of the 3rd Addl., Chief Judicial Magistrate, Bengaluru be quash, in the interest of justice. I, the deponent do hereby verify and declare that what is stated above are true and correct to the best of my knowledge, information and belief."
5. For the aforesaid reasons, the following:
