The Superintending Engineer Operation, APSPDCL, Tirupati, Chittoor District ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondents in floating issuing the tenders for manning and maintenance of 33/11 KV Sub- stations by making the entire District as one Unit, in respect of Kadapa District through a Single Contract System instead of multiple Contract System in Operation Circle, Kadapa, under the jurisdiction on the 3rd Respondent, though each 33/11 KV Sub-station was treated as one unit in all other Seven (7) Districts of APSPDCL, through Memo No.CGM/O/SPDCL/TPT/O&M F.Manning of SS / D.No. 996/15, dated 18-05-2015 and E-Procurement Tender No. KDP 01/2015-16, dated 02-07-2015, issued by the 2nd Respondent, as arbitrary, illegal and violative of Articles 14, 19 (1) (g) and 21 of the Constitution of India, contrary to the provisions of Information Technology Act, 2000 and consequently set aside the said Memo NO.CGMO/SPDCL/TPT/O&M/F.Manning of SS/D.No.996/15, dated 18-05- 2015 and E-Procurement Tender No. KDP-01/2015-16, dated 02-07-2015, issued by the 2nd Respondent and direct the Respondents to reissue the Tender Notice as per the old procedure on par with the other Seven (7) Districts of APSPDCL, by treating each 33/11 KV Sub station as one unit and pass IA NO: 1 OF 2015(WVMP 2816 OF 2015 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to vacate the interim orders dt. 16-7-2015 passed in WPMP NO. 28139 of 2015 in WP NO. 21842 of 2015 and dismiss the Writ Petition as devoid of merits 3 IA NO: 2 OF 2015(WPMP 28139 OF 2015 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to stay all further proceedings pursuant to the Memo No. CGM/O/SPDCL/TPT/O&M/F.Manning of SS/D.No.996/15, dated 18-05-2015 and E-Procurement Tender No.KDP-01/2015-16, dated 02-07-2015, issued by the 2nd Respondent, while directing the Respondents to reissue the Tender Notice as per the old procedure on par with the other Seven (7) Districts of APSPDCL, by treating each 33/11 KV Sub-Station as one unit, pending disposal of the above writ petition and pass IA NO: 5 OF 2015(WPMP 134149 OF 2015 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Counsel for the Petitioners: CHANDRAIAH SUNKARA Counsel for the Respondents: JAGARLAMUDIKOTESWARIDEVI(SC FORAPSPDCL) The Court made the following order: 4 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:21842 OF 2015 ORDER: No representation on behalf of the petitioners. Heard the learned counsel for the respondents. 2. The present Writ Petition is filed challenging the tender notice dated 02.07.2015 issued by the respondent No.2 on the ground that the same was issued in e-procurement mode rather than the manual mode and requested to re-issue the notice as per the old procedure. 3. Learned Standing Counsel for the respondents submits that the proposed tender is only for a period from 01.08.2015 to 31.03.2016 and the said period was already elapsed. 4. Since the period of tender is completed by 31.03.2016 itself, no cause survives for further adjudication and the matter becomes infructuous. 5. Accordingly, the writ petition is closed as infructuous. There shall be no order as to costs.
