Learned counsel for the petitioner submits that petitioner was transferred from Govt. Middle School Pahandorpurv, District-Durg to Govt. Middle School Jhiriya Block- Bemetara, District Bemetara on 07.06.2025 under rationalization policy. He contended that prior to passing of order of transfer of petitioner, Headmaster of Middle School Pahandorpurv, District-Durg, who also also a Maths teacher, was promoted to the post of Principal and therefore post for the Teacher (Maths) became vacant in the said school. However, while considering representation submitted by petitioner, Divisional Level Committee has not considered the said aspect. 2. Learned counsel for the State submits that representation of the petitioner was rejected by the Divisional Level Committee constituted under rationalization policy against which petitioner is having remedy to file further appeal before the State Level Committee headed by Director Public Instructions. 3. At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to submit representation/appeal before the State Level Committee and direction be issued to Committee to consider and decide representation within specified time frame. 4. In view of submission of learned counsel for the parties, this writ petition at this stage is disposed off permuting the petitioner to submit representation/appeal before the State Level Committee and if such 3 / 3 representation/appeal is submitted, State Level Committee shall consider and take decision on the same within further period of 4 weeks from the date of receipt of representation.
