Both the parties have participated in mediation on 28.01.2026, 05.02.2026, 12.02.2026, 26.02.2026 and 05.03.2026 they have agreed to settle their matter by drawing an agreement with following terms and conditions: a) The petitioner has agreed to pay the entire bill amount of Rs.1,70,96,979 (Rupees One Crore Seventy Lakhs Ninety-Six Thousand Nine Hundred and Seventy Nine Only) (principal BBC- Rs.1,12,42,174/- (Rupees One Crore Twelve Lakhs Forty Two Thousand One Hundred and Seventy Four Only) and 50% of the approved interest amount to Rs.58,54,805/- (Rupees Fifty Eight Lakhs Fifty Four Thousand Eight Hundred and Five Only) outstanding against RRNO: N4HT-818 HT installation at Ms ICT Service Management Solutions India Pvt. Ltd. as full and final settlement of the claims of the 2nd respondent. - 4 - HC-KAR NC: 2026:KHC:21405 WP No. 20389 of 2021 b) Accordingly the petitioner states that they have already paid the bill amount of Rs.1,70,96,979 (Rupees One Crore Seventy Lakhs Ninety-Six Thousand Nine Hundred and Seventy Nine Only) as full and final settlement vide UTR No.CITIN26649352220 dated: 07.04.2026. The respondent acknowledges the receipt of the said payments. c) Both the parties agreed that there are no other claims against each other apart from what is agreed above, on the basis of the orders challenged before this Hon'ble Court in the above W.P.20389/2024. III. That the Parties submit that, in view of the aforesaid terms of settlement arrived at between them the Hon'ble Court may be pleased to pass appropriate orders disposing of the writ petition as settled." 2. The said memorandum of settlement is taken on record. 3. The authorized signatory of the petitioner - Vinay Joseph and the Assistant Executive Engineer - Rajesh Kumar, representing respondent Nos.3 and 4 are present - 5 - HC-KAR NC: 2026:KHC:21405 WP No. 20389 of 2021 before this Court and confirmed the settlement arrived at through Mediation. 4.
