The petitioners are apprehending their arrest in connection with Katkamsandi P.S. Case No. 189 of 2023, registered for the offence under Sections 323, 354, 380, 386, 406, 420, 504, 506/34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Hazaribag. 3. Learned counsel appearing for the petitioners submits that the petitioner no.1 is the brother of the informant, petitioner no.2 is the nephew of the informant and petitioner no.3 is daughter-in-law of petitioner no.1 and the allegations are made that the petitioners have taken Rs.1,50,000/- for executing the sale deed, however, the sale deed was not executed. He next submits that if any case is made out that is civil in nature and criminal case cannot be instituted. 4. Learned counsel appearing for the State has opposed the prayer and submits that the allegations are there of taking money and not executing the sale deed. 5. Considering that petitioner no.1 is the brother of the informant, petitioner no.2 is the nephew of the informant and petitioner no.3 is daughter- in-law of petitioner no.1 and allegations are of not executing the sale deed, in the attending facts and circumstances, the above-named petitioners are directed to surrender before the learned Court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribag, in connection with Katkamsandi P.S. Case No. 189 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Anit Uploaded 04.05.2026
