The petitioner is serving as the headmaster of a high school. He is due to retire on attaining his normal age of superannuation on 28th February, 2026. He alleges that certain amount is due and payable to him on account of arrear salary and 20 years’ service benefit increment on acting as the headmaster of the school totaling to Rs.32,79,531/-. 2. From the documents annexed to the writ petition, it appears that there is a communicating memo from the District Inspector of Schools (Secondary Education), Paschim Medinipur dated 7th of June, 2023 requiring the petitioner to submit necessary documents for payment of his arrear bills. 2 3. There is nothing on record to suggest that the petitioner acted in terms of the request made by the District Inspector of Schools. 4. There is, however, a representation dated 2nd December, 2025 by the petitioner received by the office of the District Inspector of Schools on 9th December, 2025 requesting releasing payment. It is not clear as to whether the supporting documents of the claim have been forwarded by the petitioner to the District Inspector of Schools. 5. None represents the State respondents despite service. 6. Affidavit of service and the notice of upgradation filed in Court are taken on record. 7. In the absence of any representation from the State, it is not possible for the Court to decide the issue conclusively. 8. As it appears that the representation of the petitioner seeking release of the arrear dues is pending consideration at the end of the District Inspector of Schools, accordingly, the instant writ petition stands disposed of by directing the District Inspector of Schools (Secondary Education), Paschim Medinipur to consider the petitioner’s prayer for releasing his arrear dues strictly in accordance with law, at the earliest, but positively within a period of twelve weeks from the 3 date of communication of this order. 9. 9. The petitioner shall be obliged to submit all supporting documents in respect of his claim. 10. A reasoned order shall be passed and communicated to the petitioner. 11. If the claim of the petitioner is accepted, then necessary consequential steps shall be taken by the District Inspector of Schools without any further delay. 12. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
