Kolkata Police Station Case No. 01 of 2021 dated 03.01.2021 under section 21(c)/22(c)/29 of the NDPS Act. And In the matter of : Rabiul Hussain @ Hossain ……Petitioner. Ms. Saba Parween ……for the Petitioner. Mr. Bitashok Banerjee Ms. Sreetama Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 5 years and 3 months. Earlier this petitioner approached the Hon’ble Supreme Court wherein Special Leave to Appeal (Crl.) No. 14538 of 2024 was passed. There was a direction to conclude the trial by 31st October, 2025. Learned advocate for the State submits that the examination-in-chief of the last witness was completed on 4th September, 2025 and since then the accused has been continuing the cross-examination. Presently, the date has been fixed for examination of the accused under Section 313 of Cr.P.C. 2 Having considered the advanced stage of the proceedings, I am not inclined to release the petitioner on bail having regard to the fact that there was alleged recovery of 26 Kgs. of Yaba Tablets and 2 Kgs. of Heroin. Accordingly, CRM (NDPS) 623 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
