No.18018 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, to issue any writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the respondents in mutating and recording the name of the respondent No. 5 in respect of land to an extent of Ac. 1.84 cents in Sy.No. 346-2A, Ac. 1.50 cents in Sy.No. 346-2B and Ac. 1.50 cents in Sy.No. 346-2C of Jarapatidinne, H/o. Kotala Village, Thamballapalle Mandal, Chittoor District (now Annamayya District) without notice, enquiry, due process as illegal, arbitrary and unconstitutional; and consequently direct the respondents to conduct a comprehensive enquiry into the petitioners claim by considering the petitioners’ representation, dated 27.02.2026, in accordance with law and pass such other order as this Court deem fit and proper. 2. The case of the petitioners, briefly stated, is as follows: The petitioner No. 1 is the owner and possessor of the subject lands and has been cultivating the same for several decades. The petitioners Nos. 2 to 3 are sons of the petitioner No.1. The respondent authorities failed to protect the property of the petitioner No. 1 and illegally mutated the subject lands in favour of the respondent No. 5 without issuing any notice or providing an opportunity to the petitioner No.1. Challenging the illegal mutation of the entries in the revenue record and illegal interference, the petitioner No. 1 filed appeal vide ROR-Appeal No. LIDS.B4 / 3326 / 2018, dated 15.10.2018 before the competent authority. It is still pending. Hence, this writ petition was filed. 3 BSB,J W.P. No.18018 of 2026 3. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, placed on record a copy of written instructions of the respondent No. 4, vide Roc.No.A / 47 / 2026, dated 08.07.2026, mainly stating that the subject lands are ceiling lands and that after following due process of law, the lands were recorded in favour of the respondent No. 5 in the year 2015, vide khata No. 157 of Kotala Village of Thamballapalle Mandal, and since then, he has been in possession and enjoyment of the same, however, the petitioner No. 1 has been exerting pressure on the revenue officials by making representations one after other, without showing any documentary evidence in support of the claim of title or possession and that the R.O.R. appeal is pending. 4. In response to the written instructions, the learned counsel for the petitioners requested to dispose of the writ petition directing the concerned respondent to dispose of the appeal by fixing time. 5. The learned Assistant Government Pleader for Revenue submitted that the petitioner failed to file any piece of paper / record in support of his contentions. 6. Upon consideration of the evidence of the writ petitioner and the written instructions and oral submissions made, this Court is of the view that the writ petition can be disposed of with appropriate directions. 7. Accordingly, the writ petition is disposed of directing the respondent No. 3 to expeditiously dispose of the R.O.R.-Appeal No. LIDS.B4 / 3326 / 2018, dated 15.10.2018, as early as possible, not later than two (02) months from the date of receipt of copy of this order, by providing opportunity of hearing and filing documents, if any, by the petitioners. 4 BSB,J W.P.
