JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: "PRAYER WHEREFORE, the Petitioner most respectfully prays that this Hon'ble Court be pleased to : A. Issue of Writ of Mandamus or any other writ or order directing the Respondent Bank to consider Petitioner oral request for permission to dispose of the Schedule Property to the interested buyers and to realise the sale consideration; B. To further extend the time thereafter to repay the loan amount due without interest, penal interest, etc., under one time settlement scheme, in accordance with law. C. To grant such other relief under the circumstances of this case, as this Hon'ble Court may deem fit in the interest of justice and equity." 2. Learned counsel for the petitioner submits that the property is sold and the writ petition has become infructuous. 3. The writ petition is filed against Jana Small Finance Bank Ltd. which is a private company and in the light of the law - 3 - HC-KAR NC: 2026:KHC:15448 WP No. 8994 of 2023 laid down by the Hon'ble Apex Court in case of S.Shobha Vs. Muthoot Finance Ltd.1, the writ petition is not maintainable. 4. Accordingly, on both grounds, the writ petition is dismissed. i. All I.As. in this petition shall stand closed.
