ORDER Date : 12.06.2026 Heard Mr. P. Hazarika, learned counsel for the accused/applicant. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor for the State.
2. This is an application filed under Section 482 BNSS, 2023, praying for pre- arrest bail for accused/applicant in connection with Panigaon P.S. Case No. 02/2026 under Section 75(2)/296/351(4) of the BNS, 2023.
3. The FIR lodged on 14.02.2026 alleged that the accused/applicant had
Page No.# 2/2 been harassing her by various means such as circulating her edited obscene photographs in many groups; that she had been molested by the accused/applicant while she was travelling with him. That the victim girl was being harassed mentally and physically by the accused/applicant on many occasions; that due to such harassment, the victim girl is going through deep mental pressure.
4. On receipt of the FIR, the police registered Panigaon P.S. Case No. 02/2026 under Section 75(2)/296/351(4) of the BNS, 2023. This Court vide
order dated 09.03.2026 had granted interim pre-arrest bail to the accused/applicant with a direction to appear before the investigating officer within a period of 10(ten) days.
5. Case diary in the instant case has been received and the same is perused.
6. The learned Additional Public Prosecutor appearing for the State submits that the accused/applicant has approached this Court not with clean hands as he did not disclose about the rejection of earlier bail by the learned Additional District and Sessions Judge (FTC), North Lakhimpur, Lakhimpur.
7. Taking into account the materials available in the case diary as well as the conduct of the accused/applicant in approaching this Court without disclosing the rejection of earlier bail application, this Court is of the opinion that the interim bail granted earlier vide dated 09.03.2026 is to be cancelled.
8. Accordingly, the instant bail application is rejected and disposed of by cancelling the interim bail order dated 09.03.2026. JUDGE Comparing Assistant
