18.02.2026 Court No.35. D/L.33. Rakib (Rejected) CRM (M) 281 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hastings Police Station DD case no. 83 of 2025 dated 16.09.2025 under Sections 61(2)/310(2) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Faiyaz Ahmed. ……Petitioner. Mr. Sk Toslim Ali ……for the Petitioner. Mr. Avishek Sinha Mr. Santanu Talukder ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for five months and has been falsely implicated in connection with the instant case. Learned advocate for the State opposes the prayer for bail and emphasizes on the conspiracy, participation and recovery at the instance of the present petitioner. Having considered that in respect of similarly placed accused person in CRM (M) 268 of 2026 the prayer for bail has been rejected. On an assessment of the overall circumstances appearing in the Case Diary, I am of the view that so far as the present petitioner is concerned no new circumstance or distinguishing features appear. Accordingly, the prayer for bail of the petitioner in CRM (M) 281 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
