1. Heard learned Counsel Ms. N.Gogoi for the accused-applicant and Mr. R.J.Baruah, learned Addl.Public Prosecutor for the respondent State.
2. The primary allegation against the accused-applicant is that the accused- applicant being the Manager of the concerned Bank without verifying the
Page No.# 2/3 qualification, granted loan to several persons.
3. The co-ordinate Bench of this Court on 21.04.2026 granted interim pre- arrest bail to the accused-applicant and the direction to co-operate with the investigation.
4. Learned Counsel appearing for the accused-applicant submits that in terms of the order dated 21.04.2026, the accused-applicant has already appeared before the I.O. and got his statement recorded. She submits that he will continue to co-operate with the investigation and his custodial detention at this stage may not be required.
5. Learned Addl.Public Prosecutor on the other hand submits that the investigation in the instant case is yet to be completed and therefore, at this stage, pre-arrest bail should not be granted to the accused-applicant.
6. This court has gone through the Case Diary that has been produced before the Court as well heard the submissions made by the learned counsel for the respective parties.
7. Taking into account the whole aspects of the matter, this Court is of the considered opinion that interim pre-arrest bail granted to the accused-applicant vide order dated 21.04.2026 should be made absolute.
8. Accordingly, the interim pre-arrest bail granted to the accused-applicant vide order dated 21.04.2026 is hereby made absolute in the same terms and conditions as stated in the aforesaid order dated 21.04.2026.
9. The instant anticipatory bail application is disposed of.
