Learned counsel for the petitioner after arguing for some time submits that transposition was sought before the learned Trial Court on the ground that Dr. Raj Ishwar D. Khare is neither the founder trustee nor an authorized person to file any reply on behalf of the trust in the suit. 3. Learned counsel for the petitioner submits that an objection to that effect has already been raised in the reply. 4. Learned counsel for the petitioner submits that the application for transposition has been declined, whereas, the issue ought to be framed, whether Dr. Raj Ishwar D. Khare is entitled to represent the trust. 5. Therefore, learned counsel submits that he may be permitted to withdraw the present writ petition with liberty to approach the learned Trial Court for framing additional issues on the basis of the pleadings of the parties. Accordingly, the present writ petition is dismissed as withdrawn with liberty to the petitioner to approach the learned Trial Court by way of an appropriate application seeking amendment/addition of issues based on the pleadings of the parties.
