IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.3412 of 2026 Saurab Das …. Petitioner Mr. A. R. Panda, Advocate -versus- State of Odisha …. Opposite Party Mr. P. K. Ray, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 29.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with Special Case No.1 of 2026 pending on the file of learned Additional Sessions Judge-cum-Special Court, Jaleswar arising out of Jaleswar P.S. Case No.1 of 2026 for commission of offence alleged under Sections 21(b)/29 of the NDPS Act. 3. The case of the prosecution in brief is that on 01.01.2026 at about 5:00 PM, the informant, S.I. Karan Marndi of Nampo C.P., acting on instructions from his superior, conducted a raid with police staff at Ambliatha Chhak. During the raid, he apprehended the accused, Sujay Kumar Samant, and seized from his conscious possession: (i) 140 grams of brown sugar in a sealed blue envelope (Exhibit A), (ii) a black purse containing ID and ₹10,000 cash, (iii) two VIVC smartphones, and (iv) a Yamaha motorcycle bearing registration No. WB35C-2841. Hence, the FIR has been lodged. 4. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 5. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Additional Sessions Judge-cum-Special Judge, Jaleswar by order dated 31.03.2026 in the aforementioned cases, the present BLAPL has been filed. 6. This is the second journey of the Petitioner to this Court, post-framing of charge. 7. It is submitted by the learned counsel that since charge has already been framed and the Petitioner has no criminal proclivity, he may be enlarged on bail. 8. Such submission is opposed by the learned counsel for the State, inter alia, on the ground that the Petitioner is a flight risk. 9. Taking into account the quantity of contraband, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin so as to ensure his presence during the trial subject to verification of criminal antecedent of similar nature from his parent police station. 10. Additionally, it is directed that the Petitioner shall appear before the jurisdictional Police Station once a month. 11. Accordingly, the BLAPL stands disposed of. 12. Urgent certified copy of this order be granted as per rules. (V. NARASINGH) Judge Jina
