The petitioners claim to be the owner of several plots of land within Mouza Chandigarh under Police Station Maheshtala in the District of South 24 Parganas. The petitioners allege that though the said plots were initially requisitioned under the provisions of the West Bengal Land (Requisition & Acquisition) Act, 1948 and thereafter a notice under Section 4(1a) of the 1948 Act was issued but no award was passed within the prescribed time limit resulting in lapsing of the acquisition proceeding. The petitioners further alleged that no further step for acquisition of the land either by issuing a notice under Section 9(3A) or 9(3B) of the Land Acquisition (West Bengal Amendment ) Act, 1997 was taken. The learned advocate appearing for the petitioners submits that the property of the petitioners has been utilised without paying any compensation to the
2 petitioners. The petitioners submitted a representation dated 4th January, 2023 before the Special Land Acquisition Officer, 24 Parganas (South) being the 3rd respondent. He further submits that no decision on such representation has been communicated to the petitioners till date. Mr. De, learned Additional Government Pleader submits that the decision on the said representation shall be communicated to the petitioners within the time limit as may be fixed by this Court. Since the property of the petitioners is claimed to have been utilized without paying any compensation, it is the duty of the respondent authorities to communicate the decision on the representation submitted by the petitioners.
Without entering into the merits of the claim made by the petitioners in the representation dated 4th January, 2023, WPA 27878 of 2023 stands disposed of by directing the Special Land Acquisition Officer, 24 Parganas (South) being the 3rd respondent to consider the representation of the petitioners dated 4th January, 2023 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioners or their authorized representative and communicate the reasoned order to the petitioners as expeditiously as possible but positively within a period of six weeks from the receipt of a
3 server copy of this order together with a copy of the representation dated 4th January, 2023. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
