For Petitioner(s): Mr.K.Gokula Krishnan For Respondent(s): Mr.S.Vinoth Kumar, Government Advocate (Crl.Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 28.12.2025 for the alleged offence under Section 109 of BNS in Crime No.817 of 2025 on the file of the respondent police, seeks bail. 2. It is the case of the prosecution that there was a love affair between the petitioner and the de facto complainant’s daughter and due to a wordy quarrel between them, the petitioner attacked the victim, due to which the victim https://www.mhc.tn.gov.in/judis CRL OP No.5947 of 2026 __________ Page2 of 4 sustained grievous injury in her leg and spinal cord. Hence the case. 3.The learned counsel for the petitioner submits that the petitioner and the victim were involved in a love affair. He further submits that the petitioner has been falsely implicated in this case and he is no way connected to this case and the petitioner is in judicial custody from 28.12.2025. Hence, he seeks this Court to grant bail to the petitioner. 4.The learned Government Advocate (Crl.Side) while opposing grant of bail to the petitioner submitted that the victim suffered serious leg injury and injury in the spinal cord and if the petitioner is enlarged on bail, it would cause great prejudice to the life and well being of the victim. He further submits that the petitioner has got two previous cases registered against him. 5.I have given anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. 6.From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the victim has suffered grievous injuries, including fracture of her leg, and that her spinal cord has also been severely affected. Though the learned Government Advocate (Crl.Side) contended that the petitioner and the victim were in a love affair, considering the nature and https://www.mhc.tn.gov.in/judis CRL OP No.5947 of 2026 __________ Page3 of 4 gravity of the offence, this Court is of the view that if the petitioner is enlarged on bail, it would cause great trauma to the victim. Further, taking into account the fact that the petitioner has two previous cases registered against him, this Court is not inclined to grant bail to the petitioner.
