Item No.11 30.03.2026 Court. No. 12 GB MAT 467 of 2026 With CAN 1 of 2026 West Bengal Finance Corporation Vs. Samrat Imaging Private Limited & Ors. Mr. Kuldeep Mullick, Mr. Sannidhya Dutta, Mr. Abhik Chitta Kundu … for the Appellant. Ms. Writi De, Ms. Riya De … for the Respondent No.1. 1. We are not inclined to interfere with the ad interim order passed by His Lordship on February 17, 2026. An impugned notice dated January 13, 2026 issued by the General Manager (AMD) of the appellant was stayed up to March 12, 2026. The date of taking over possession of the mortgaged land was fixed on February 18, 2026 and the writ petition was taken up on February 17, 2026. His Lordship was of the view that the appellant was required to be heard and as such, the notice dated January 13, 2026 was stayed till March 12, 2026 or until further order whichever was earlier. The order was passed ex- parte 2. It is informed to us that the interim order has not been extended, although an application is pending. 3. Under such circumstances, we request His Lordship to take up the matter within two weeks, by 2 permitting the appellant to mention the matter and file a report in the form of an affidavit annexing the documents which have been annexed to the stay application in this appeal. Whether interim protection should be granted will also be decided on the next date. 4. The learned advocate for the appellant contends that the writ petition suffers from gross suppression and various letters and communications prior to the issuance of the notice had not been brought on record. The ad interim order was passed upon the writ court being misguided. This issue will also be decided by His Lordship. We leave all points open, to be agitated before the learned court, including the allegation of suppression. 5. Accordingly, the appeal and the connected application are disposed of. 6. Parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.) (Ajay Kumar Gupta, J.)
