Petitioner has challenged the impugned transfer order dated 30.06.2026 issued by respondent No.3, whereby, he was transferred from Electricity Sub- Station, Piran Kaliar to Community Health Centre, Laldhang.

Learned counsel for petitioner submits that since petitioner is having qualification of I.T.I. (Electrical), therefore, he should be transferred to the Electricity Department where he was working in the year 2019, when he was appointed. He further submits that petitioner is working as Computer Operator in Electricity Department, Piran Kaliyar and now he has been transferred to Community Health Centre, Laldhang.

Learned counsel for petitioner further made a prayer that ends of justice would be met if petitioner is

2026:UHC:5649 2 permitted to make a fresh representation before the competent authority and if a direction be issued to competent authority to consider and decide the said representation moved by petitioner.

From perusal of the writ petition, it transpires that the petitioner is discharging his duties as Computer Operator, therefore, the transfer order cannot be interfered with on this ground only. However a limited interference is warranted.

Accordingly, writ petition is disposed of, permitting the petitioner to move a fresh representation within 10 days from the date of production of certified copy of this order. If such representation is moved by petitioner within 10 days, the said representation shall be decided by respondent-Competent Authority within six weeks’ from the date of receipt of representation, in accordance with law.

Pending application stands disposed of.
