With the consent of learned counsel appearing for the parties, this case is heard finally. 2. Petitioner has filed this writ petition seeking following reliefs: “10.1 To call for entire records pertaining to the case for kind perusal of the Hon'ble High Court. 10.2 To set aside the impugned order dated 01.06.2025 (annexure P/3). 10.3 To set aside the impugned order dated 11.09.2025 (annexure P/6). 10.4 To set aside advertisement dated 01.10.2025 (annexure P/7) as also all actions taken pursuant to advertisement may kindly be declared null and void. 10.5 To direct respondent to place the petitioner's posting at the place Block Chhura. 10.6 To grant any other ancillary relief (s), as it may deem fit and proper in facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that petitioner has been declared to be Teacher in excess in Govt. Primary School, Satnami Para Karkara, Block -Chhura and is transferred to Primary School situated at Kunderapani, Block- Mainpur under rationalization policy. He has joined on the vacant post in the school at Kunderapani, Block- 3 / 4 Mainpur. He contended that after passing of order dated 01.06.2025 respondent authority have published an advertisement on 01.10.2025 for appointment of Teachers as Gaurav Shiksha Pradata on honorarium basis. 27 posts have been advertised out of which 8 schools of Chhura Block has been advertised and therefore there is arbitrariness on the part of respondents in not publishing the list of those schools at the time of counseling proceedings. 4. Learned counsel for the State submits that looking to the nature of grievance as raised in this writ petition and further considering that representation submitted by petitioner before District Level Committee has been rejected, petitioner is having other alternate remedy of submitting representation before the State Level Committee headed by Director of Public Instructions. 5. At this stage, learned counsel for the State submits that petitioner will submit representation before the State Level Committee, however, till decision is taken, respondents be directed not to fill up the vacant post of Chhura Block as advertised by respondent vide advertisement dated 01.10.2025. 6. Considering the submission of learned counsel for the parties, nature of grievance raised and further considering the petitioner has been posted to other school at Mainpur Block under rationalization scheme treating him to be in excess in the Govt. Primary School Satnami Para, Karkara, Block Chhura, petitioner is permitted to submit fresh representation before State level Committee raising all the grounds as raised by him in earlier petition including the ground raised in this writ petition pursuant to advertisement dated 01.10.2025 and if such 4 / 4 representation is submitted within 15 days, the State Level Committee shall consider and decide the same in accordance with law keeping in mind the availability of post in Chhura Block as published in advertisement dated 01.10.2025 expeditiously, preferably within a period 4 weeks from the date of receipt of representation. 7. Till decision is taken on the representation to be submitted by petitioner it is directed that posts advertised for Gaurav Shiksha Pradata in the school situated at Chhura Block shall not be filled up. 8.
