UKHC010118552026 2026:UHC:5743-DB IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL THE HON’BLE CHIEF JUSTICE MR. MANOJ KUMAR GUPTA AND THE HON’BLE JUSTICE MR. SUBHASH UPADHYAY SPECIAL APPEAL NO. 304 of 2026 14th July, 2026 Mohmmad Shamin -----Appellant Versus State of Uttarakhand and Others ----Respondents ---------------------------------------------------------------------- Presence:- Mr. Vinod Nautiyal, learned counsel for the appellant through V.C. Mr. Rajeev Singh Bisht, learned Deputy Advocate General for the State. ---------------------------------------------------------------------- JUDGMENT : (per Mr. Manoj Kumar Gupta C. J.) 1. The present appeal is directed against the order of learned Single Judge dated 10.06.2026, by which, a challenge made to the transfer order dated 06.06.2025 has not been examined on the ground that the appellant had already joined the transferred place long back. 2. Learned counsel for the appellant submits that the appellant joined the transferred place, as he was given assurance that after one year, he would be transferred back to the same place. 3. We find no such material on record. 4. The learned Single Judge has rightly not examined the challenge made to transfer order dated 1 UKHC010118552026 2026:UHC:5743-DB 06.06.2025 which exhausted itself with the appellant joining the transferred place one year back. 5. Accordingly, the special appeal is dismissed. 6. Pending application, if any, also stands disposed of. (MANOJ KUMAR GUPTA, C. J.) (SUBHASH UPADHYAY, J.) Dated: 14.07.2026 KKS/PP 2
