4. Heard learned counsel for the parties.
5. Petitioner was an employee of Uttarakhand Payjal Nigam, who served as a Work Agent. He retired from service on 31.03.2026.
6. Since retiral dues of petitioner have not been paid to him, therefore, this writ petition has been filed by him seeking the following relief:-
“i) Issue a writ, order or direction in the nature of mandamus commanding the respondents to forthwith release the Gratuity, Leave Encashment and Arrears of Seventh Pay Commission and other admissible dues mentioned in paragraph no.7 of the writ petition to the petitioner.
7. In paragraph no. 8 of the writ petition, it is stated that the amount due towards Gratuity, Leave Encashment and arrears of Dearness Allowance has not been paid to the petitioner.

8. Mr. S.S. Chauhan,
learned counsel for respondent no.2 while admits the liability of Nigam to pay retiral dues to petitioner, however, submits that due to resource crunch, payment could not be made to petitioner so far. He assures the Court that the dues would be paid to petitioner as soon as possible.
9. After hearing the learned counsel for the parties, the writ petition is disposed of with the following directions:- (i) Within a period of three months from today, the amount of Gratuity and Leave Encashment shall be paid to the petitioner. (ii) Within a period of five months from today, the amount of Dearness Allowance shall be paid to the petitioner. (iii) Other dues, if any, shall be paid to petitioner within a period of seven months from today. (iv) It is further directed that if the Corporation has moved the Government seeking funds, the State Government will consider the said request in accordance with law at the earliest.
