No.15963 of 2025 has been filed for condonation of delay of 255 days in filing the present Civil Miscellaneous Petition. 2. The learned counsel for the petitioners has referred to paragraph 8 of the interlocutory application. 3. Considering the averments made, the delay is condoned. Accordingly, I.A. No.15963 of 2025 is allowed. C.M.P. No. 51 of 2026 4. This petition has been filed for restoration of CMP No.935 of 2024, which stood dismissed on 17.01.2025 on account of non- compliance or peremptory order dated 06.12.2024. 5. The learned counsel for the petitioners has submitted that CMP No.935 of 2024 was filed for restoration of W.P.(S) No. 4284 of 2023 which was earlier rejected on 18.06.2024 on account of non- compliance of peremptory order dated 17.05.2024. He has submitted that in spite of best of efforts, the order passed in CMP No.935 of 2024 with respect to removal of defects in the writ petition could not be complied. 6. The learned counsel for the State has opposed the prayer and submitted that the order of CMP was passed on 06.12.2024 and after about a year, the restoration application has been filed. 7. To this, the learned counsel for the petitioners submits that if the CMP is not restored, the writ petitioners would suffer irreparable loss and injury who are in total 49 in numbers. 2026:JHHC:12894 5 8. After hearing the learned counsels for the parties, this Court finds that in spite of repeated opportunities, the defect in writ petition being W.P.(S) No. 4284 of 2023 was not removed. 9. However, considering the aforesaid facts and circumstances, the time for removal of defect in W.P.(S) No. 4284 of 2023 is extended till 19.06.2026, subject to payment of cost of Rs.10,000/- in the Advocate’s Clerk Association, whose details are as under: “Advocate Clerk Association Bank of India, Jharkhand High Court, Doranda A/C No.: 495810100101411 IFSC Code: BKID00004958” 10. The receipt regarding payment of cost should be filed in this case latest by 12.06.2026, failing which the writ petition shall not be restored and this petition will stand dismissed without reference to a bench. 11. If the cost is deposited and the defects in the writ petition are removed by 19.06.2026, the office is directed to place the writ petition before appropriate Bench as per roster. 12.
