The present intra Court appeal has been filed impugning the judgment and order dated 17.11.2025 passed by the learned Single Judge in W.P.No.25552/2013 (S-R), instituted by the appellant/petitioner.

3. Petitioner had approached the writ Court, being aggrieved by his non-selection to the promotional cadre of SMGS-V from SMGS-IV, w.e.f. 01.11.2012. The petitioner was initially appointed on 28.06.1972 as a Typist-cum- Clerk in the respondent No.1 - State Bank of Mysore now the State Bank of India. He was promoted in Group B (Merit channel) as a Deputy Manager MMGS-II. Thereafter he was promoted as Deputy Manager MMGS-III and then as Senior Manager SMGS-IV. The Bank issued a circular on 30.08.2012 laying down the policy for promotion for the year 2012-2013. As per the policy, the promotion from SMGS-IV to SMGS-V was merit based promotion and the marks awarded for AARF for best 4 out of 5 was 80 and 20 marks was for the interview. Out of 80 marks for AARF, the petitioner could score 74.30 marks and in the interview out of 20 he scored 10 marks. This was petitioner's sixth attempt to claim promotion. Even in the earlier five attempts the petitioner ranked at the lowest level in the merit list amongst the candidates, who were

considered for promotion and faced the interview. The marks obtained after interview by each candidate have been placed on record before the writ Court by the respondent/Bank and it would suggest that the petitioner had scored total 84.30 marks. All other 15 candidates have scored higher marks than the petitioner. The petitioner is the only candidate in the list of 16 candidates, who has attempted sixth time for promotion.
4. Considering the aforesaid fact that even in the sixth attempt the petitioner was the lowest scorer in the selection process, therefore, in our view the petitioner does not have a right for promotion if he has not fared well in the selection process.
5. We find no reason to interfere with the impugned
judgment and order dated 17.11.2025 passed by the learned Single Judge. Accordingly, the writ appeal is dismissed being devoid of merit.

6. In view dismissal of the appeal, pending interlocutory applications, if any, do not survive for consideration, hence stand disposed of. Sd/- (D K SINGH) JUDGE
