2. The petitioner is apprehending his arrest in connection with C.P. Case No. 317 of 2024, registered for the offences under Sections 302 and 34 of the Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Bokaro.

Learned counsel appearing for the petitioner submits that Pindrajora P.S. Case No. No. 153 of 2021 was investigated by the police and final form was submitted showing that the occurrence took place due to an accident. He further submits that on the basis of said final form, the complainant has taken the compensation by

way of Annexure-7 to the tune of Rs. 4 lakhs from the Government. He then submits that thereafter due to enmity, the complaint case- cum-protest petition has been lodged against the petitioner, on which, the learned court has been pleased to take cognizance. He next submits that in identical situation co-accused persons have already been granted anticipatory bail in A.B.A. No.7409 of 2025.

Learned counsel appearing for the State has opposed the prayer and submits that the learned court has taken the cognizance on the protest-cum-complaint petition.

Considering that the case was investigated by the police and final form was submitted showing that the occurrence took place due to an accident and on the basis of said final form, the complainant has taken the compensation by way of Annexure-7 to the tune of Rs. 4 lakhs from the Government and thereafter on the protest-cum-complaint petition, the learned court has been pleased to take cognizance against the petitioner and in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid A.B.A., I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of

the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bokaro in connection with C.P. Case No. 317 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
