JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: “a. Call for Records from the Respondent Nos.1 to 14. b. Pass an order in the nature of writ of Mandamus directing the Respondents No.1 to 14 not to dispense the pension to the Respondent No.15 as per Annexure-P1 dated 20.08.2018. c. Pass an order in the nature of writ of Mandamus directing the Respodnent No.1 to 14 to recover of all teh benefits obtained during the course of Respondent No.15 employment and after the retirement of his position to meet the ends of justice as per Annexure-G1 dated 06.02.2025, G2 dated 10.03.2023, G3 dated 02.02.2023 and P1 dated 20.08.2018. d. Pass an order in the nature of Writ of Mandamus to register criminal case against the Respondent No.15. e. Pass such other order/s that this Hon’ble Court may deem fit to grant in the nature and circumstances of the case in the interest of justice and equity.” 2. Heard learned counsel for the petitioner, learned AGA for respondent Nos.1 and 3 and learned counsel for respondent No.2 and perused the material on record. 3. A perusal of the material on record will indicate that the petitioner is an advocate, who is aggrieved by inaction on the part - 5 - HC-KAR NC: 2026:KHC:17591 WP No. 1957 of 2025 of respondent Nos.1 to 14 to take action against the respondent No.15. However in the facts and grounds urged in the Memorandum of Writ Petition, the locus standi of the petitioner to ventilate his grievances against respondent No.15, who is not connected to the petition, in any manner whatsoever, is not forthcoming in the present petition. In fact, at paragraph Nos.4 to 8 of the writ petition, the petitioner has stated as under: “4. The facts of the case in brief are that, the Petitioner is one of the colleague of Advocate Manjunath C.S and Advocate Yuvaraju G. The Respondent No.15 had been visited the office for the Advocate Manjunath C.S and Advocate Yuvaraju.G for due verification of his Service Documents for the reasons that, the complaints given was continuously coming from 3rd Parties against him. On due verification of the documents which was provided by the Respondent No.15, petitioner, Manjunath and Yuvaraju.G came to know that the Respondent No.15 has secured the employment of CASUAL LABOUR by producing illegal documents and had been cheated the Government Authority. 5. The Petitioner made several attempts to seek the documents from the Respondent No.2 to 14 but all efforts went vein. Thus, with no other alternative the petitioner had filed several RTI Application's in order to get the documents and necessary information to know the fraudulent act conducted by the Respondent No.15 to the - 6 - HC-KAR NC: 2026:KHC:17591 WP No. 1957 of 2025 State Government for the purpose of securing the government employment. 6. The Petitioner submits that, for the purpose of knowing the education qualification of the Respondent No.15. The petitioner had filed an RTI Application Dated: 11.07.2024 requesting the Respondent No.12 to provide with the admission details of the Respondent No.15 and to which effect the petitioner receive a reply letter Dated:06.08.2024 from the Respondent No.12 stating that, the admission of the Respondent No.15 has been rejected on 26.05.1969 due to regular absence and not coming to school. The Copy of the RTI Application dated: 11.07.2024 and the Original Copy of Reply Letter Dated:06.08.2024 are herewith produced for Kind perusal of this Hon'ble Court as ANNEXURE-A and B. 7. It is further submitted that, the petitioner came to know that from the Annexure-B that, the Respondent No.15 had not even attended school nor completed his primary education and got himself issued a fraudulently created Transfer Certificate from the Respondent No. 12. 8. The Petitioner submits that, once the admission of the Respondent No.15 had taken as rejected and the same was brought on record in the Admission Record Book on.26.05.1969, then the question of Providing the Transfer Certificate does not arise, but it was shocking and surprising to see that in the Admission Record Book, it is mentioned that,, the Respondent No.15 had left with Transfer Certificate bearing No: 2/80-81 - 7 - HC-KAR NC: 2026:KHC:17591 WP No. 1957 of 2025 Dated:09.05.1980. The certified copy of the Admission Record Book issued by the Respondent No.12 is herewith produced for the kind perusal by this Hon'ble Court as Annexure-C.” 4. In my considered opinion, the averments made by the petitioner in the present petition cannot be construed or treated as making the petitioner an aggrieved party nor give him locus standi to request respondents Nos.1 to 14 to initiate any action against the respondent No.15, especially when the petitioner is not an employee of the respondent Nos.2 to 4, nor is his interest affected in any manner whatsoever by respondent Nos.1 to 14 or respondent No.15. Under these circumstances, on this short ground of want/lack of locus standi on the part of the petitioner to file the present petition, the same is thereby dismissed.
