1. The petitioner has filed the present writ application praying for a direction upon the respondent authorities to release the outstanding bill amount of Rs.47,00,455/- along with the interest @ 12% per annum.
2. Learned counsel for the petitioner submits that the authorities have issued the work order to the petitioner from time to time and accordingly the petitioner has completed the work and submitted the bill.
3. Out of the total bill, the respondent authorities have released some part amount but an amount of Rs.47,00,455/- is pending.
4. This Court has called for the report from the authorities and accordingly the Executive Engineer, PWD, Asansol Electrical Division, Government of West Bengal has submitted a report admitting that approval of payment of
2 Rs.47,00,455/- is under consideration before the authorities.
5. This Court finds that the authorities have admitted the claim of the petitioner for a sum of Rs.47,00,455/-.
6. Accordingly, the writ petition is disposed of by directing the respondent no. 8, The Secretary Finance Department, Government of West Bengal to sanction the amount of Rs.47,00,455/- within eight weeks from the date of receipt of this order and after sanction of the amount by the respondent no. 8, the respondent no. 12 shall release the amount in favour of the petitonr within two weeks thereafter.
7. Report submitted by the State be kept with the record.
8. WPA No. 26399 of 2025 is disposed of.
9. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
