This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of Cr.M.P. No.4108 of 2023 to its original file. Learned counsel for the petitioners submits that Cr.M.P. No.4108 of 2023 was dismissed for non-compliance of the peremptory order of this Court dated 12.01.2026 whereby the petitioners were directed to deposit Rs.1,000/- with the Jharkhand State Legal Services Authority (JHALSA) within four weeks. It is next submitted that the learned counsel for the petitioners handed over the file along with Rs.1,000/- to his clerk for depositing the same before JHALSA but the Advocate’s Clerk has all of a sudden moved to his native place to serve his ailing mother without handing over the file to the other connected person, hence the order dated 12.01.2026, passed in the said Cr.M.P. No.4108 of 2023 could not be complied within the stipulated time, resulting in dismissal of the same. It is then submitted that the non-compliance of the order dated 12.01.2026, passed in the said Cr.M.P. No.4108 of 2023 was neither deliberate nor intentional. It is next submitted that the petitioners have very good grounds to agitate in the said Cr.M.P. No.4108 of 2023 and unless Cr.M.P. No.4108 of 2023 is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that Cr.M.P. No.4108 of 2023 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, Cr.M.P. No.4108 of 2023 is restored to its original file to the stage at which, it was before its dismissal.
