Heard learned counsel for the applicants, learned counsel for the informant, and learned A.G.A. for the State. 2. The present 482 Cr.P.C.application has been filed to quash the charge sheet dated 23.02.2024, cognizance/summoning order dated 12.04.2024 and the entire prosecution of the applicants, under Sections 498A, 323, 504, 506, 354, 354-A I.P.C. and 3/4 D.P. Act, in Criminal Case No. 2191 of 2024 (Arising out of Crime No. 663 of 2023), Police Station Murad Nagar, District Ghaziabad, (State Versus Waris and others), pending before the Additional Civil Judge (Junior Division), Court No.1, Ghaziabad. 3. Learned counsel for the applicant submitteds that applicant no.1-Mohd. Waris is husband of opposite party no.2. The marriage was solemnized between the applicant no.1 and the opposite party no. 2 on 11.08.2020 with Muslim rites and rituals, without any demand of dowry. Thereafter, on account of some matrimonial dispute, the opposite party no.2 lodged the present first information report under Sections 498A, 323, 504, 506, 354, 354-A I.P.C. and 3/4 D.P. Act against the husband and in-laws and 10 other members of family including the applicant no.1-husband. Thereafter applicants have challenged the proceedings and this Court vide order dated 28.08.2024 referred the matter before the Mediation Centre and parties have entered into compromise and amicably settled their dispute out of the Court. As per mediation center report dated 22.01.2025, parties have entered into compromise and they are living happily as husband and wife as per Para No. 7 of the mediation centre report 22.01.2025, which is extracted below:- 7. अंतिरम समझौता िदनांक 04.12.2024 के अनुसार वादकािरयों के बीच में िनम्निलिखत समझौता सम्पन्न हुआ है:- क. यह िक दोनो पक्ष अंतिरम समझौता िदनांक 04.12.2024 से सौहादर् पूणर् एंव स्नेह पूवर्क Versus Counsel for Applicant(s) : Sudhir Kumar Counsel for Opposite Party(s) : Akash Srivastava, Avinash Singh Chauhan, G.A., Virendra Singh Chauhan Mohd Waris And 9 Others .....Applicant(s) State of U.P. and Another .....Opposite Party(s) बतौर पती पत्नी के रूप में रह रहे है एंव आज मध्यस्थ के समक्ष उपिस्थत हैं और कथन करते हैं िक आगे भी वे दोनों पूणर् सौहादर् और स्नेह पूवर्क साथ-साथ रहेंगें तथा वैवािहक जीवन के दाियत्वों का िनवार्हन करेंगें तथा एक दूसरे का सम्मान करेंगें। ख. यह िक पित आश्वस्त करता है िक वह अपनी पत्नी एवं पुत्री का पूरा ध्यान रखेगा एवं उनकी सभी ज़रूरतों और आवश्यकताओं को पूणर् करेगा। ग. यह िक पती एवं पत्नी ऐसा कोई कायर् नहीं करेंगे िजससे िकसी भी पक्ष को मानिसक या शारीिरक रूप से ठेस पहुंचे और वे अपनी गितिविधयों से एक-दूसरे को संतुष्ट करने का प्रयास करेंगे। घ. यह िक पक्षों के बीच इस बात पर भी सहमित बनी है िक वे शांितपूणर् और सौहादर्पूणर् माहौल में रहकर उिचत व्यवहार करेंगे। ङ. यह िक दोनो पक्षकारों के सगे-संबंधी दोनो के शांितपूणर् वैवािहक जीवन में हस्तक्षेप नहीं करेंगें। च. यह िक दोनो पक्ष एक दूसरे के िवरूद्ध पंजीकृ त िवचाराधीन समस्त वादो को वापस लेंगे। छ. यह िक दोनो पक्ष एक दूसरे के िखलाफ, इस वैवािहक वाद के संदभर् में कोई नया वाद दायर नही करेंगे। 4. Learned counsel for the applicants also submitted that applicant no.1 and opposite party no.2 compromised the matter and opposite party No.2 does not want to proceed the matter against the applicants. He further submitted that applicants and opposite party no.2 have settled through compromise their private and civil dispute and as such opposite party no.2 does not wish to press the aforesaid case against the applicants. Opposite party no.2 is ready to withdraw the prosecution of the applicants and in view of the compromise, no fruitful purpose would be served if the prosecution is allowed to go on. 5. Learned counsel appearing for the opposite party no.2 does not dispute the correctness of the submission made by learned counsel for the applicants or the correctness of the documents relied upon by them. He submits that opposite party no. 2 has no objection, if the proceedings in the aforesaid case are quashed. 6. Learned AGA submitted that both the parties have settled their dispute out of the Court, hence, no reason to proceed further. 7. The Hon'ble Apex Court in the case of Narindra Singh and others Vs. State of Punjab, (2014) 6 SCC 466, Parbatbhai Aahir @ Parbatbhai Vs. State of Gujarat (2017) 9 SCC, 641, Gian Singh Vs. State of Punjab (2012) 10 SCC 303 and State of M.P. Vs. Laxmi Narayanan (2019) 5 SCC 688, wherein Hon'ble Apex Court has categorically held that compromise can be made between the parties even in respect of certain cognizable and non-compoundable offences. Reference may also be made to the decision A482 No. 26848 of 2024 2 given by this Court in Shaifullah and others Vs. State of U.P. and another [2013 (83) ACC 278], in which, law expounded by the Hon'ble Apex Court in the aforesaid cases has been explained in detail. 8. Considering the facts and circumstances of the case, as noted herein above, and also the submissions made by learned counsel for the parties, this Court is of the considered opinion that no useful purpose would be served by prolonging the proceedings of the above mentioned case. 9. Accordingly, charge sheet dated 23.02.2024, cognizance/summoning order dated 12.04.2024 and the entire prosecution of the applicants, under Sections 498A, 323, 504, 506, 354, 354-A I.P.C. and 3/4 D.P. Act, in Criminal Case No. 2191 of 2024 (Arising out of Crime No. 663 of 2023), Police Station Murad Nagar, District Ghaziabad, (State Versus Waris and others), pending before the Additional Civil Judge (Junior Division), Court No.1, Ghaziabad are hereby quashed. 10.
