JUSTICE S.R.KRISHNA KUMAR - 3 - HC-KAR NC: 2026:KHC:23389 WP No. 9810 of 2026 ORAL ORDER In this petition, petitioner seeks the following reliefs: "a) Issue a Writ of certiorari or any other appropriate writ, quashing the order in No.,NSFDC/HR/DPC/2025 dated 11.03.2026 as per Annexure-A and communication in No.NSFDC/Pers/205/94/Vol.IV/7320 dated 24.03.2026 as per Annexure-F, issued by Respondent No.2. b) Consequently, issue a Writ of mandamus directing the respondents to retain Petitioner at Bengaluru only in his present cadre of Assistant General Manager. c) Pass any other appropriate order as this Hon'ble Court deems fit to meet the ends of justice and equity. " 2. Heard learned counsel for the petitioner and learned DSGI for respondent Nos.1 and 2. 3. When the matter came up before this court on 24.04.26, this Court passed the following interim order: "Learned counsel for the petitioner submits that the petitioner is due to attain the age of superannuation on 27.02.2027 and since there are various litigation between the petitioner and his wife – Smt. Mrunal V Salkute, it is necessary that the petitioner continues to be stationed at Bengaluru and he is not insisting on being promoted to the post of Deputy General Manager and intends to continue to work as Assistant General Manager at Bengaluru till he attains the age of superannuation. Learned DSGI seeks time to secure instructions. Objections filed by respondents is taken on record. Re-list on 27.04.2026 for preliminary hearing. - 4 - HC-KAR NC: 2026:KHC:23389 WP No. 9810 of 2026 Interim order granted earlier is extended till the next date of hearing." 4. Learned counsel for the petitioner as well as the petitioner who is physically present jointly submits that in the event the petitioner is not transferred from Bangalore to Delhi, the petitioner would unconditionally withdraw the entitlement/eligibility of being promoted from the post of Assistant General Manager at Bengaluru to the post of Deputy General Manager at Delhi and the present petition may be disposed of quashing the impugned transfer order and by directing the petitioner to be retained in Bengaluru in the post of Assistant General Manager till he attains the age of superannuation on 28.02.2027. 5. Per contra, learned DSGI on instructions fairly submits that in the event the petitioner would withdraw his claim/eligibility/entitlement for promotion from the post of Assistant General Manager to Deputy General Manager and to be transferred to Delhi, the present petition may be disposed of quashing the impugned transfer cum promotion order by issuing appropriate directions. - 5 - HC-KAR NC: 2026:KHC:23389 WP No. 9810 of 2026 6. In view of the aforesaid facts and circumstances and the submission made by both sides as well as the petitioner who is physically present before this Court, in the peculiar/special/unique facts and circumstances obtaining in the instant case and without making the present order a precedent nor having any precedential value for any purpose whatsoever, I deem it just and appropriate to dispose of this petition quashing the impugned transfer order subject to the condition that the petitioner would not be entitled to claim eligibility/qualification to be promoted to the post of Deputy General Manager and by directing the respondents to continue the petitioner to be retained at Bengaluru in the post of Assistant General Manager till he attains the age of superannuation on 28.02.2027.
