Let affidavit-of-service, as filed in Court, be kept on record. 2. In spite of service, none appears on behalf of the school authorities. 3. The prayer of the petitioner seeking transfer was considered by the Commission and a communication has been made to the petitioner on June 19, 2025 mentioning that there are two other candidates for his first and second preferred schools, who have applied under “medical reason” on the ground of higher rank than the petitioner. The petitioner had applied under general ground. 4. In the event higher ranked candidates do not opt for such preferred schools, the petitioner will get the opportunity to get transferred to one of his preferred schools. In such circumstances, it is imperative that all three candidates be called at 2 the same time to enable the Commission to assess the merit and eligibility of the best candidate who will be appointed to the preferred school. 5. In view of the aforestated, the order dated August 19, 2025, passed by the Commission, is set aside. 6. With the aforestated directions, the writ petition is, thus, disposed of. 7. There shall, however, be no order as to costs. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
