Heard the parties. The petitioner has moved before this Court for grant of bail in connection with Ratu P.S. Case No. 346 of 2025 registered for the offences punishable under sections 121(1), 121(2), 132, 109, 111, 338, 336(3), 317(5), 318(4) & 3(5) of the B.N.S., 2023 along with Sections 25(1-B)a, 26, 27 & 35 of the Arms Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is a member of a Gang of criminals known as Dubey Gang and opened fire upon the Police Personnel at the checking point, where, the bullet hit the government jeep and Police also returned the fire and criminals were hit by the bullet. During interrogation, they disclosed that the petitioner and the co-accused person, namely, Atis Das were waiting for them at a short distance. It is further submitted that the Police apprehended the petitioner also and loaded country-made 7.65 mm of pistol was recovered from the petitioner with magazine containing six live cartridges and from the right pocket of his pants, one magazine loaded with seven live 7.65 mm cartridges was recovered. From the Bolero Vehicle, that was under the possession of the petitioner, in a sack, four country-made pistols were recovered, where each
one was fitted with magazine. Additionally, four separate magazines were also found in the sack and ten live cartridges were also recovered. From the middle seat of the Bolero Vehicle, two number plates bearing registration no. WB40AK 4312 was recovered. Further, the petitioner failed to give any satisfactory answer. It is further submitted that the petitioner is also having one more case vide Jama P.S. Case No. 65 of 2018 as has been mentioned in para no. 14 of this bail application, and in that case, the petitioner is on bail.
It is further submitted that the allegations against the petitioner are all false and the petitioner has been in custody since 11.10.2025, as has been mentioned in paragraph no. 16 of the bail application. It is lastly submitted that the petitioner is ready and willing to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. opposes the prayer for bail and submits that the petitioner is a hardened criminal and his gang of criminals are involved in extortion and collection of levy and the notoriety of the petitioner is evident from the huge cache of arms and ammunitions recovered from him and the vehicle, of which he was in possession of. It is next submitted that the petitioner is a threat to the law-and-order situation in the locality, and in view of the criminal antecedent of the petitioner, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail. Considering the serious nature of allegation against the petitioner and the chance of the petitioner absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the prayer for bail of the petitioner.
