APHC010319882019 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3521] FRIDAY, THE 14th DAY OF AUGUST 2026 PRESENT THE HONOURABLE DR JUSTICE Y. LAKSHMANA RAO CRIMINAL REVISION CASE NO: 1060/2019 Between: A KISTIAH, S/O RAMANAIAH, HINDU, AGED ABOUT 60 YEARS, R/O M R O PALEM, PODALAKUR VILLAGE ANDMANDAL,SPSR NELLORE DISTRICT. ...PETITIONER AND THE STATE OF ANDHRA PRADESH, Represented by its Public Prosecutor, High Court of Andhra Pradesh at Amaravathi. ...RESPONDENT Counsel for the Petitioner: M RAVINDRA Counsel for the Respondent: PUBLIC PROSECUTOR (AP) 2 Dr.YLR,J Crl.R.C.No.1060 of 2019 Dated 14.08.2026 The Court made the following: ORDER: The Criminal Revision Case has been filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C.,’), challenging the judgment dated 29.07.2019 passed in Crl.A.No.228 of 2016 by the learned VII Additional District and Sessions Judge, Gudur, whereby the learned Appellate Court partly confirmed the judgment dated 15.07.2016 passed in C.C.No.409 of 2011 by the learned Additional Judicial Magistrate of First Class, Gudur. 2. The petitioner/Accused No.1 is present before this Court and is aged about 65 years. 3. Mr. M. Ravindra, learned counsel for the petitioner, submits that the learned Trial Court convicted the petitioner and sentenced him to undergo simple imprisonment for a period of six months and to pay a fine of Rs.2,000/-. The learned Appellate Court, while modifying the sentence, directed the petitioner to pay a fine of Rs.20,000/-. 4. The learned counsel for the petitioner further submits that the petitioner/Accused No.1 has already paid the fine amount of Rs.20,000/- as imposed by the learned Appellate Court. 5. Per contra, the learned Assistant Public Prosecutor submits that the petitioner/Accused No.1 has already paid the fine amount of Rs.20,000/- as 3 Dr.YLR,J Crl.R.C.No.1060 of 2019 Dated 14.08.2026 imposed by the learned Appellate Court. He further submits that he has no objection to disposing of the Criminal Revision Case and, in view of the payment of the fine amount, appropriate orders may be passed accordingly. 6. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 7. Thoughtful consideration is bestowed on the arguments advanced by the learned Counsel for both sides. I have perused the entire record. 8. Now the point for consideration is: “Whether the judgment in Crl.A.No.228 of 2016 dated 29.07.2019 on the file of the learned VII Additional District and Sessions Judge, Gudur, is correct, legal, and proper with respect to its finding, sentence, or judgment, and there are any material irregularities? And to what relief?” 9. On perusal of the record, this Court finds no merit in the Criminal Revision Case. The learned Trial Court, upon appreciation of the oral and documentary evidence on record, rightly convicted the petitioner for the offence punishable under Section 324 of ‘the IPC’. The learned Appellate Court, on re-appreciation of the entire evidence, rightly confirmed the conviction while modifying the sentence. 10. It is also brought to the notice of this Court that the petitioner/Accused No.1 has already paid the fine amount of Rs.20,000/- as imposed by the learned Appellate Court. The said submission is recorded. This Court finds no error apparent on the face of the record, material 4 Dr.YLR,J Crl.R.C.No.1060 of 2019 Dated 14.08.2026 irregularity, jurisdictional error or miscarriage of justice warranting interference in exercise of its revisional jurisdiction. 11. In view of the above, no further orders are necessary in the present Criminal Revision Case. Accordingly, the Criminal Revision Case is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
