Learned advocate appearing for the petitioners submits that the petitioners are in custody since 17th July, 2025 and the subject matter of the present case relates to alleged recovery from the possession of the petitioners and another 191.4 grams of Yaba Tablets. Learned advocate further refers to the order dated 11.02.2026 passed by the learned Judge, Special Court under NDPS Act and submits that there were non-compliance of Section 47 of the BNSS as the grounds of arrest were not supplied to the present petitioners and to that effect learned special court did not adhere to the principle settled by the Hon’ble Apex Court and rejected the prayer for bail of the petitioners on the grounds of Section 37 of the NDPS Act.

Learned advocate for the State opposes both the contentions and submits that the grounds of arrest were supplied to the present petitioners. It has also been contended that the quantity of contraband seized is of commercial quantity.
Having regard to the subject matter of the case, I am of the opinion that the quantum of seizure in the present case do attract the rigors of Section 37 of the NDPS Act.
Accordingly, the prayer for bail of the petitioners in CRM(NDPS)418 of 2026 is rejected at this stage.
