By means of this writ petition, petitioner has sought following relief: “To issue a writ, order or direction in the nature of mandamus directing and commanding the respondent Municipal Corporation to take immediate and effective steps to repair and construct the road in front of his house while performing its statutory duty under Section 114(xxix) read with Section 290 of the Municipal Corporation Act, without being influenced by any extraneous reasons.” 3. Petitioner contends that the road leading to his house is not properly maintained and problem of waterlogging is being faced on said road. 4. Learned State Counsel, however, submits that there is a civil suit for injunction UKHC010113442026 2026:UHC:5537 pending between respondent no. 6 and petitioner in which, order of temporary injunction has been passed. It is thus submitted that because of temporary injunction granted by civil Court, it is not possible to make any development on the road. 5. This Court do not find any scope for interference, there are hundreds of roads within Municipal Corporation, Dehradun and many such roads are facing the problem of waterlogging. If petitioner has any grievance in the matter, then he should have approached the Municipal Authority or other competent authority. This Court cannot issue direction to Municipal Corporation to develop the road leading to the house of petitioner. Thus relief as claimed cannot be granted. 6. Writ petition fails and is dismissed.
