In this petition, preferred under Section 528 of BNSS 2023, the applicants are questioning the issue of remand since the trial is stayed by the Division Bench and by submitting that only in a pending trial remand can be given. 5. There is no dispute that the Division Bench stayed the trial court proceeding but subsequently the another Division Bench clarified the earlier order of the Division Bench whereby the trial proceeding was stayed by observing that even if the trial court proceedings are stayed there is no impediment to give accused on remand. 6. Since, Division Bench already clarified the position, therefore, the instant C528 petition lacks merit and is dismissed, however, there will be no impact of dismissal of the pending proceeding, if any, and will not prejudice the right of the applicants.
