Learned advocate for the petitioner submits that the petitioner has been charged for recovery of 300 bottles of phensedyl/cough syrup and he is detained in custody for 1 year 10 months. Learned advocate for the petitioner also submits that the petitioner has no antecedent.
Learned advocate for the State opposes the prayer for bail and submits that out of 16 witnesses proposed to be examined, 10 witnesses have already been examined.
Having considered the period of detention of the present petitioner, I am of the view that substantial period petitioner is in
2 custody, as such, further detention of the petitioner is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Abdul Gofur Biswas shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Nadia without the permission of the learned special court. In case of violation of any conditions, learned special court will cancel the bail of the petitioner without further reference to this Court.
Accordingly, CRM (NDPS) 48 of 2026 is allowed.
