Rathi, learned counsel for the applicant and also head Ms. A. Page No.# 2/2 Gayan, learned CGC, appearing for the respondents/opposite parties. This interlocutory application under Section 5 read with Section 14 of the Limitation Act is preferred by the applicant for condonation of delay of 15 days in preferring the connected appeal against the judgment and order dated 26.08.2025, passed by the learned Railway Claims Tribunal, Guwahati Bench, in Original Application No.OA III/GHY/150/2013 (Old). Mr. Rathi, learned counsel for the applicant submits that the applicant herein is a senior citizen and he was not well, for which the appeal could not be preferred in time and that the delay is not intentional, rather it is circumstantial and under such circumstances, he has contended to allow this application. Ms. Gayan, learned counsel for the opposite parties submits that she has no objection. Accordingly, taking note of the submission of learned counsel for both the parties and also considering the explanation so put forwarded in paragraph Nos.3 and 4 of the application, this Court is of the view that the delay is sufficiently explained and as such, the same stands condoned. Now the Registry is to register and number the appeal and list the same before the Court as soon as practicable. In terms of above, the I.A. disposed of. Comparing Assistant Sd/- Robin Phukan JUDGE
