JUSTICE PRAVEER BHATNAGAR Order 25/05/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 100/2024 registered at Police Station Civil Lines, District Ajmer for the offences under Sections 419, 420, 465, 467, 468, 471 and 120-B of IPC and Section 3/10 of Rajasthan Public Examination Act, 2022. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the main allegation of submitting the forged MA degree was against beneficiary Brahma Kumari who has already been enlarged on bail by this Court vide order dated 24.09.2024. It is also contended that similarly placed co-accused Kaushal Kishore has also been enlarged on bail by this Court vide [2026:RJ-JP:22066] (2 of 2) [CRLMB-5533/2026] order dated 24.09.2024 and the other co-accused Mahendra Singh, Somesh, Suresh and Rajesh were enlarged on bail by the Trial Court vide different orders. It is also contended that the petitioner is in custody since 18.02.2026 and charge-sheet has already been submitted. Apart from one case, there are no other criminal antecedents against the accused-petitioner and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Considering the fact that the other co-accused have already been enlarged on bail and the accused-petitioner is in custody since 18.02.2026, charge-sheet has already been submitted, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Dhawajkirti Sharma S/o Shri Pyarchand Sharma, in connection with FIR No. 100/2024 registered at Police Station Civil Lines, District Ajmer, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
