The accused- petitioners have been arrested in connection with FIR No. 05/2026 registered at Cyber Police Station District Sawaimadhopur for the offences under Sections 319(2), 318(4), 316(2), 61(2)(a) of BNS and Section 66-C and 66-D of IT Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioners have falsely been implicated in this case. He further submits that prima facie offence under Section 318(4) is not made out against the petitioner, victim Arush and Abhishek Sharma refused to give their statements. The FIR was lodged on the information received by Rajasthan police from the Uttar Pradesh police that petitioners are selling papers of examination for the post of S.I. conducted in the year 2026. It is also contended that concerned Investigating Officer has not recorded the statement of police officials but inform that petitioners are selling paper for the post of SI conducted by Uttar Pradesh State. The accused-petitioners are in custody since 14.03.2026 and the trial of the case may take considerable time. There are no criminal antecedents against the petitioner, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the parties and looking to the fact that the accused-petitioners are [2026:RJ-JP:22089] (3 of 3) [CRLMB-5199/2026] in custody since long and the trial of the case may take considerable time. There are no criminal antecedents against the petitioners and charge-sheet has already been submitted before the concerned trial court, therefore without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners 1. Sumit Meena Alias Loda S/o Shaitan Singh, 2. Mohammad Sahil S/o Abdul Kalam, 3. Sajid S/o Abdul Ajij, in connection with FIR No. 05/2026 registered at Cyber Police Station District Sawaimadhopur shall be enlarged on bail provided they furnish personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
