This is the second bail application 3led under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.129/2025 registered at Police Station-Civil Lines, District - Raipur (C.G.), for the o=ence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of BNS, 2023. 2. The earlier bail application of the applicant being MCRC No. 5743 of 2025 was rejected by this Court vide order dated 23.07.2025 on merits. 3. The case of the prosecution is that, for the prevention of cybercrime, the Government of India has established a Cyber Crime Reporting Portal ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.02.13 18:17:42 +0530 2 through which victims can report incidents of cyber fraud. On the basis of information received through this portal, it came to light that as many as 128 bank accounts opened in di=erent branches of the Bank of Maharashtra at Raipur (IFSC Codes: MAHB0000439, MAHB0001928, MAHB0002335, and MAHB0002400) were being used to receive the proceeds of cyber fraud. Acting upon the said information and in accordance with the directions of the Police Headquarters, Police Station Civil Lines, Raipur registered Crime No. 129/2025 under Sections 317(2), 317(4), 317(5), 111, and 3(5) of the BNS. Subsequently, a case was registered against the holders of the said 128 bank accounts, treating them as “mule accounts,” and the matter was transferred to the Cyber Crime Police Station, Raipur for further investigation, as it was alleged that these accounts were being used by cybercriminals for routing and transferring fraudulent funds. It is further alleged that a sum of Rs. 38,40,208/- was deposited in the Applicant’s bank account bearing No. 60434134194 in the Bank of Maharashtra. It is also alleged that one complainant, Ujjal Chatterjee, was defrauded to the tune of Rs. 33,00,000/-, which was reported vide Acknowledgement No. 33412240011298 on the Cyber Crime Portal/1930 of the Ministry of Home A=airs, Government of India. 4. The learned counsel for the applicant submits that the 3rst bail application of the applicant was rejected by this Court on merits. The second bail application of the applicant is being preferred on the grounds that the co-accused person namely, Avinash Tandekar has already been released on bail by this Court in MCRC No. 08.01.2026 in MCRC No. 148 of 2026. Therefore, he prays for grant of regular bail to the applicant on the ground of parity. 5. On the other hand, learned State counsel opposes the bail application of 3 the present applicant and submits that the applicant/accused, in collusion with other co-accused persons, committed a cybercrime and facilitated the opening of 128 bank accounts involving an amount of Rs. 38,40,208/-, therefore, the applicant is not entitled to the grant of regular bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From a perusal of the pleadings, it appears that the ground raised by the applicant is that a co-accused, namely Avinash Tandekar, has already been granted bail by this Court. However, the case of the present applicant stands on a di=erent footing, as the allegation against the applicant is that, in collusion with other co-accused persons, he committed cybercrime and facilitated the opening of 128 bank accounts involving an amount of Rs. 38,40,208/-. No new ground has been raised in this second bail application. Considering the applicant’s alleged involvement in online fraud, I do not 3nd any suDcient ground to grant bail. Hence, this second bail application is rejected. 8. Accordingly, the second bail application of the applicant – Pradeep Jamulkar, 3led under Section 483 of the BNSS, involved in Crime No.129/2025 registered at Police Station-Civil Lines, District - Raipur (C.G.), for the o=ence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of BNS, 2023, is rejected. 9. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 10.
