In continuation of the order passed on 07.09.2026, the learned counsel appearing for the applicant, upon instructions, submits that the trial court proceedings have now been adjourned to 22.09.2026 for hearing before the charge. He further, on instructions, submits that as this court has expressed its disinclination to allow the application on merits, he has instructions to withdraw the application with liberty to file afresh application within a period of six weeks from today, in case there is no substantial progress in the trial. 2. The APP submits that as the matter is already posted for framing of charge and the trial is likely to start, this Court may grant liberty, after a period of one year, if the trial is not substantially progressed. 3. Taking into consideration that the matter is posted for hearing 1 of 2 929ba1131-26 before charge, I am inclined to grant liberty to the applicant to file afresh application before the learned trial court after a period of eight months, in case, there is no substantial progress in the trial. In casr such an application is preferred, the learned trial court shall decided the same on its own merits. 4. The Bail Application stands disposed of as withdrawn with liberty as aforesaid.
