Also heard Ms. B. Sarkar, learned counsel for the respondent Nos.1—5 and Mr. K. Bhattacharyya, learned Government Advocate, appearing for the respondent Nos.6 and 8. This interlocutory application is preferred by the applicants for staying the impugned judgment and decree dated 04.11.2023, passed by the learned Civil Judge (Sr. Division), Hailakandi, in Money Suit No.10/2019. Mr. Bora submits that the connected appeal has already been admitted for hearing and the record has also been called for and as such, there is a requirement of staying the impugned judgment and decree dated 04.11.2023. Ms. Sarkar, learned counsel for the respondent Nos.1—5 submits that she has no objection in the event of staying the impugned judgment and decree dated 04.11.2023. Page No.# 4/4 However, she submits that the applicants may be directed to deposit 50% of the decretal amount before the Registry of this Court with a liberty to the respondent No.1 to withdraw the same. Taking note of the submission of learned counsel for both the parties, this interlocutory application stands allowed. The impugned judgment and decree dated 04.11.2023 stands stayed, subject however to depositing of 50% of the decretal amount before the Registry of this Court within a period of 4(four) weeks from today and on such deposit being made by the applicants, the respondent/opposite party No.1 herein shall be at liberty to withdraw the same.
