JUSTICE ANJAN MONI KALITA ORDER Date : 10.06.2026 Heard Mr. S.S. Ahmed, learned counsel appearing for the accused/ applicants. Also heard Mr. K.K Das, learned APP for the State. This is an application under Section 482 of the BNSS,2023 praying for granting of pre-arrest bail to the accused/ applicants, namely 1. Anowar Zaman, 2. Abu Bakkar Ali @ Abu Bakkar Siddique, 3. Aynal @ Ainal Hoque and, 4. Omor @ Amar @ Amor Faruk, in connection with Chapor P.S. Case No.41/2026 under Sections 191(2)/ 126(2)/ 127(2)/ 118(2)/ 3(5) of the BNS,2023. An FIR was lodged on 16.04.2026, alleging a quarrel with an altercation took place between the family of the informant and the accused persons whereby the accused persons inflicted severe injuries on the family members of the informant. A co-ordinate Bench of this Court vide order dated 20.05.2026 has granted interim pre-arrest bail to the accused/ applicants with the condition that the accused/ applicants shall appear before the investigating officer within 7 (seven) days. The learned counsel for the accused/ applicants submits that in terms of Page No.# 3/3 the aforesaid order dated 20.05.2026, the accused/ applicants have already appeared before the investigating officer and got their statements recorded. The aforesaid fact was confirmed by the learned APP appearing for the State. Taking into account the aforesaid facts this Court is of the considered opinion that the interim pre-arrest bail order dated 20.05.2026 should be made absolute. Accordingly, the interim pre-arrest bail granted to the accused/ applicants vide order 20.05.2026 is made absolute with same terms and conditions as stated therein.
