ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused on bail in FIR No.131 of 2026 of Mylavaram Police Station, NTR Commissionerate, registered against the Petitioners/Accused herein for the offences punishable under Section 318(4), 319(2) of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) read with Sections 66-C and 66-D of the Information Technology Act, 2000-2008 (and Section 111 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) as added in the Remand Report) Mr. Nuthalapati Mohan, learned counsel for the Petitioner, submits that Petitioner is a Doctorate holder and a graduate of I IT Kharagpur. The Petitioner is a law-abiding citizen and undertakes to abide by any conditions that this Court may deem fit to impose while granting bail. Hence, it is urged that the petition be allowed. Per contra, Mr. A. Sai Rohit, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioner, submitting the investigation is still in progress and several witnesses remain to be examined. It is contended that if the Petitioner is released on bail at this stage, there is a strong likelihood of his absconding, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing
submissions, it is urged that the petition be dismissed.

learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. On a perusal of the material available on record, it is evident that the petitioner has been in judicial custody for the past 64 days pursuant to his arrest on 16.06.2026. Except for the offence under Section 111 of the BNS, the remaining offences are punishable with imprisonment of less than seven years. The petitioner is a Doctorate holder and a graduate of NT Kharagpur. The allegation against the petitioner is that he had undertaken several projects and received caution deposits amounting to Rs. 10,00,000/-, but had failed to complete the projects as assured by him. The Principal of Lakkireddy Balreddy Engineering College lodged a complaint against the petitioner. There are altogether 11 cases pending against the petitioner involving similar allegations, wherein the petitioner was issued notices under Section 41-A of the Cr.PC./Section 35(3) of the BNSS. In some of the cases, the petitioner was granted bail. 6. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused, this Court is inclined to enlarge the Petitioner/Accused on bail with some stringent conditions. In the result, the Criminal Petition is allowed with the following stringent

i. The Petitioner/Accused shall be enlarged on bail subject to his executing a bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for the like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Mylavaram. ii. The Petitioner/Accused shall appear before the Station House Officer concerned once in a fortnight, i.e., on Saturday, between 10:00 a.m. and 05:00 p.m., till the filing of the charge sheet. iii. The Petitioner/Accused shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioner/Accused shall not commit or indulge in commission of any offence in future. V. The Petitioner/Accused shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the Investigating Officer as and when required. The Petitioner/Accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. vi.
